terms and conditions   These terms and conditions, together with the Marinsure Agreement we have also entered into (“the Agreement”), are the contract between you and us for you to access and use the Marinsure website (“Marinsure”). They explain our obligations to you and your obligations to us. You should read them carefully. These terms and conditions shall apply throughout the term of this Agreement as defined in the Marinsure Agreement.   1. Connecting to Marinsure   If you wish to use Marinsure, you are responsible for ensuring that:   i. you keep your computer hardware fully operational; and ii. you keep your software virus free; and iii. you establish and/or maintain a subscription to the Internet through an internet service provider of your choice.   2. Client Code, Password and Security PIN Number   We will give you a unique code (“Client Code”), password (“Password”) and personal identification number (“PIN”). You must keep your password and PIN secret and must take all reasonable precautions to prevent their unauthorised or fraudulent use. This includes;   i. NEVER writing your Password or PIN down in a way that someone else could easily understand; ii. NEVER telling someone else your Password or PIN, including Amlin employees;   You must tell us as soon as possible, by telephoning us on 020 7746 1037 if you know or suspect that someone else knows your Password or PIN. You must observe all our requirements given to you in writing or electronically which are designed to ensure that Marinsure is used only for authorised access to your insurance information.   3. Use of Marinsure   We will assume all communications from a user logging a valid Client Code, Password or PIN are authorised (“Authorised Communications”) and we may act on Authorised Communications. We will not be obliged to reverse or adjust any instructions or transactions resulting from Authorised Communications and we will not be liable to you for acting on or processing such instructions or transactions, or otherwise acting on Authorised Communications. You will ensure that Authorised Communications are performed only by personnel authorised by you to perform such Authorised Communications and not by any third party.   We reserve the right to decline to act on any instruction. We reserve the right not to quote on proposals submitted to us.   You may use the information provided to Marinsure for proposing insurance business to us and other underwriters. The information is provided on an “as is” basis and we do not accept any responsibility whatsoever for any use made of Marinsure or its content, including information contained within it.   You must not use Marinsure or its content (including the information contained within it) for any purpose other than those permitted by the Agreement or these terms and conditions.   4. Your Obligations   You must comply with these terms and conditions and in particular your obligations to maintain security and to alert us if there is any suspected or actual breach of security.   You must notify us, by telephoning on 020 7746 1037 immediately, if you become aware of any error or any suspected error in Marinsure. You must also notify us if you are actually aware of any error in a quotation provided to you or if any of the information you provide as part of a proposal for insurance alters or any transaction resulting from using it.   Marinsure and the information provided through Marinsure are the product of significant investment and creation of intellectual property rights belonging to Amlin Underwriting Limited and its information supplier, who for the avoidance of doubt is not a party to this contract. You agree that all copyright, trademarks, trade names, patents and other intellectual property rights ("Intellectual Property Rights") in Marinsure, its content and the right to domain names shall remain the property of Amlin Underwriting Limited or its information suppliers. You must reproduce copyright notices and proprietary rights legends on any copies of the Marinsure screens, insurance statements or information that you make.   You may not:   i. copy, transfer or alter, distribute or use any materials or design on this website except as expressly permitted by these terms and condition or as otherwise agreed between us;   ii. re-use any of our licensor’s content on this website for any purpose and for any manner whatsoever, except as expressly permitted by these terms and conditions and the Agreement.   Failure to comply with all or part of your obligations under these terms and conditions and the Agreement may at our sole discretion invalidate your access to Marinsure.   The information provided to Marinsure is to facilitate the proposal of a risk. Use of Marinsure does not absolve you from your duty in respect of a fair presentation of the risk.   If any of the information that you submit to us in the proposal changes or new information arises, you must tell us as soon as possible.   5. Data Protection   We need to collect some personal data so that you can use Marinsure. We will use that personal data:   i. to verify your identity when granting you access to the site; ii. to facilitate the proposing of insurance on behalf of your clients and to contact you in that regard; iii. to inform you of other products that we feel might be of interest to you.   By using Marinsure, you consent to us using your data for these purposes. If you would like us to stop processing your personal data, you should contact us on 020 7746 1037.   The data controller is Amlin Underwriting Ltd, whose address is St Helen’s, 1 Undershaft, London EC3A 8ND.   You warrant that you have all necessary consents from any person whose personal data you may post on to Marinsure.   6. Limitations to our Liability   In addition to, and without prejudice to, the limitations on liability contained within our Agreement, we will not be liable for any misuse of Marinsure by you or anyone else (excluding employees of Amlin Underwriting Limited), nor for any disclosure of confidential information where you have failed to take reasonable precautions to maintain the security requirements of your account with us.   We will not be liable to you for any loss you suffer due to any circumstances beyond our reasonable control which leads to Marinsure being wholly or partly unavailable, such as technical breakdown, industrial dispute, communications or power failure.   Amlin Underwriting Limited and its information suppliers attempt to make sure that any information supplied to you through Marinsure is accurate and complete. However, by reason of the immense quantity of detailed matter dealt with in compiling the information and the fact that the data is supplied from sources not directly controlled by Amlin Underwriting Limited, we and our information suppliers do not guarantee the correctness or the effective delivery of the information and will not be held liable or responsible for any errors therein or omissions therefrom.   7. Changes to Marinsure   We may alter the facilities available under Marinsure at any time.   We may suspend or withdraw the use of Marinsure at any time. If practicable, we will give you 28 days notice of this either in writing or electronically.   8. Governing Law   This site and your use of it is governed by English law and any disputes will be subject to the exclusive jurisdiction of the Courts of England and Wales.
